I am a single parent of a 4 y/o medically fragile special needs son. For 3 years I have been in and out of the hospital (in and out of state) with him and had to visit numerous specialist (in and out of state). In May he just underwent his 3rd eye surgery on an outpatient basis. My son has a history of dehydration. I have no family here and my friends are few.
To make a long story short About an hour after leaving the hospital, I got pulled over by the police for a DUI and recklace driving. I do not drink nor do I do any drugs. I just left a store from getting my son a drink and some gas and was getting on the highway headed home (2 hours away). I have a neurological disability which affects my balance and coordination. I was ask to take a sobriety test and because I couldn't pass it, no questions were ask I was handcuffed and immediately taken to jail. My son who just underwent surgery was still on the side of the road with the police. DHS paid me a visit about 5 hours after being in jail. My son was released to some people I knew in the area (but I did not know this for 8 hours after my arrest). My car was impounded with his medication inside olf it. I wasn't just arrested for DUI but also got a felony child abuse charge.
I have sold and cashed in everything that I have for legal expenses. My problem is that I am a social worker and a former DHS worker. I had to quit my job to take care of my son. Now the problem that I am having is that everywhere I go for help I know somebody. I am having severe PTSD and separation anxiety. Like I said I don't have many friends and can only cry so much with them. What do I need to do?
Have you tried talking to a law firm? Some firms have lawyers that will fight for free, it won't hurt to ask, and this seems like a forceful police situation, no questions were asked and they just handcuffed you. This seems like police abuse, and that is big with law firms usually. Just be completely honest with the court and show as much proof as you can.
I am in a small town in MS. There is no pro bono here. Anyway I have already hired a $5000 lawyer. It is what I call abuse of authority. These MS cops probably make about $8.00 an hour. I was handcuffed and took right away to jail, they didn't even ask the baby's name.

I would imagine you could sue the state over this assuming your lawyer is willing to fight.
And i really hope you do fight. This is clearly unfair for them to treat you like this especially given you had a child in your care.
Police are supposed to be able to identify people with "special needs" over those that are drunk or whatever.
Shame on them. Please keep us informed of how this turnes out.
If you are special needs, you should not of been driving. Anything that happens to you, you deserve. Endangering your son, WHO JUST WENT THROUGH SUGREY! You have PTSD, in some states it's a felony to operate a motor vehicle with that condition.

The cops did their job, you could not pass the test, thus you were arrested. If you cannot pass it, don't drive. Simple as that. Now, lets say you cannot afford to have someone drive your son. In that case, it seems your son would be better off in foster care. You stated you want the best for him, in this case, its letting go of him. Put him in a family that can actually care for him; as you obviously cannot.

Thats just silly.
So by that logic if i have one leg yet are cleared to drive yet cant pass the test then i am considered driving under the influence?
I dont think so.
