As many people said it depend's what you're downloading. It's safe to have some good known Anti Virus such as AVG or Malwarebytes

Yes it's unsafe, on-top of this it's illegal, so I don't suggest doing such things.

That stops the worry of legality sure (well 99% of the time).
But on the other hand, it's still possible to download viruses or keyloggers.

That stops the worry of legality sure (well 99% of the time).
But on the other hand, it's still possible to download viruses or keyloggers.
That's where a decent antivirus comes in handy.
I'm pretty sure new antivirus updates detects new crypts.

Yes but once it did get detected the rat would already be active on your pc and most likely won't remove it. Once the rat is there its almost impossible to get rid of without knowing exactly how.
